Code of Conduct for the use of alphanumeric Alias in company messaging services

1 Preamble
Telecom Italia Sparkle S.p.A. (“TIS”) has adopted this Code of Conduct (“Code”) pursuant to article 5, subsection 4 of resolution 42/13/CIR, of the Italian regulatory authority for communications - Autorità per le Garanzie nelle Comunicazioni - (the "Authority") setting out “Rules for the testing of alphanumerical indicators for the identification of the caller in SMS/MMS messages used for company messaging services" (the ”Resolution”), in order to discipline the rules for creating Alias and the initiatives prescribed to protect users. The code is published on the TIS website.
 

2 Definitions
For the purposes of this Code, the following definitions shall apply:

  1. Customer: the natural or legal person who uses or asks to use a company messaging service, through subscription to an offer from a supplier of company messaging services;
     
  2. End Customer: the natural or legal person who uses or asks to use an electronic communication service accessible to the public for purposes not referable to the work, commercial or professional activities they carry out;
     
  3. Company Messaging: the SMS/MMS messages sent, in single or mass mode, to End Customers by a Customer namely a Company or Institution, for social, information or advertising purposes;
     
  4. Supplier of company messaging services: a legal subject authorised pursuant to article 25 of the Electronic Communications Code ("ECC") which supplies, based on specific contracts with Customers, the company messaging service to End Customers, using Alias (cf. article 4, subsection 1);
     
  5. Supplier of access services: legal subject authorised pursuant to article 25 of the ECC that supplies mobile services, including messaging services, to the End Customer;
     
  6. CLI: Calling line identification through the number associated with said line defined by Recommendation UIT-T E.164 and nationally by the National Numbering Plan (Res. 52/12/CIR and subsequent amendments and supplements);
     
  7. Alias: string of alphanumeric characters transmitted in the specific field for the sender/CLI in the SMS/MMS messages.


3. Criteria for the constitution of Alias

  1. Customers who have subscribed to an offer for company messaging services with the supplier thereof, and have obtained in use one or more ER.164 numbers of the National Numbering Plan to associate with the Alias in accordance with article 3, subsection 2 of the Resolution, are permitted to use the Alias.
     
  2. The supplier of the company messaging service shall adopt the maximum diligence in order to avoid using Alias already used for other users and of Alias that do not differ significantly from Alias already in use.
     
  3. When associated and used by the same Customer, more than one Alias may be associated with a number assigned for the use of said Customer.
     
  4. The Alias shall be created in such a way as to facilitate to the greatest extent the identification, by the recipient, of the subject responsible for the content of the communication or of the goods or services offered therein, while at the same time reducing the possibility of inducing false identifications; it shall therefore be created in such a way as to be distinctive of the Customer, not injurious to the rights of others and not misleading for the recipient.
     
  5. Alias that refer to public Bodies and Institutions shall be reserved exclusively for said Bodies or Institutions and may not be associated to other subjects.
     
  6. Alias may not be composed of numbers only, and may not be composed of more than 11 characters.
     
  7. Alias shall be determined in accordance with the current law on trademarks.


4. Management of Alias

  1. TIS shall create a list of the Alias associated with its Customers, or with Customers that use the TIS network, including, for each Alias, at least the following information:
     
    • The Alias and associated E.164 number;
    • Name of the Customer, VAT Registration Number and Tax Code;
    • Customer Contact details, and specifically: address, telephone number and, where they exist, fax number, PEC address, website;
    • date on which the Alias was assigned to the Customer and date of cessation when the Alias is no longer in use
        
  2. The list of Alias shall be entered by TIS in the database managed by the Authority (Alias system) and shall be updated, for new Alias activated, before the start of use of a new Alias, and within 24 working hours in case of cessation.
     
  3. TIS will use its experience and diligence to ensure that Customers use Alias correctly. The correct use of an Alias by a TIS Customer is dependent upon the communication to TIS by the Customer of the information set out in point 1 above, to be entered into the Alias system. TIS shall adopt the maximum diligence in order to include suitable clauses into its contracts with Customers to ensure that the latter assume responsibility for the use of the Alias and to this end TIS may also have the Customer sign a specific declaration to this effect. Customers who are found to have used an Alias in an unlawful way will be prevented from using said Alias.
     
  4. The specific information to associate with each Alias and the methods for communicating updates may be updated after any amendments that might be made by the Authority.


5. Protection of the End Customer

  1. An End Customer who receives an SMS/MMS message originating from an Alias that he or she deems unexpected, misleading in terms of its provenance, or spam, may contact the Customer Care department of his or her mobile telephone provider notifying them of the case and communicating to them the following information, essential to enable the required checks to be made:
     
    • number of the end customer;
    • Alias that appears in the sender field of the SMS/MMS in question;
    • day, date and time of receipt
        
  2. The Customer Care division of the mobile phone provider, by interrogating the Authority database, will obtain the information regarding the Customer that sent the message and communicate this to the End Customer.
     
  3. If necessary, at the request of the offices of the Authority, TIS will immediately take all necessary measures to cease use of the Alias associated to numbers assigned.


6. Subsequent versions of the Code
TIS reserves the right to draw up new and more evolved versions of this Code in the future in order to better protect the rights of End Customers, in accordance with the evolution of the company messaging services containing Alias and of the related discipline, which is still in the testing phase.


Codice di Condotta per l’impiego di codici alfanumerici (Alias) nei servizi di messaggistica aziendale
 

1 Premessa
Telecom Italia Sparkle S.p.A. (“TIS”) adotta il presente Codice di Condotta (“Codice”) ai sensi dell’art. 5 comma 4 della delibera dell’Autorità per le Garanzie nelle Comunicazioni (“Autorità”) 42/13/CIR, recante “Norme per la sperimentazione di indicatori alfanumerici per l’identificazione del soggetto chiamante negli SMS/MMS impiegati per servizi di messaggistica aziendale” (“Delibera”), allo scopo di disciplinare le regole per la costituzione degli Alias e le iniziative previste per la tutela dell’utenza. Il Codice è pubblicato nel sito web di TIS.

2 Definizioni
Ai fini del presente Codice si definiscono:

  1. Cliente: la persona fisica o giuridica che utilizza o che chiede di utilizzare un servizio di messaggistica aziendale, attraverso la sottoscrizione di un’offerta di un fornitore di servizi di messaggistica aziendale;
     
  2. Cliente Finale: la persona fisica o giuridica che utilizza o che chiede di utilizzare un servizio di comunicazione elettronica accessibile al pubblico per scopi non riferibili all'attività lavorativa, commerciale o professionale svolta;
     
  3. Messaggistica Aziendale: le comunicazioni di tipo SMS/MMS, in modalità singola o massiva, verso Clienti Finali da parte di un Cliente, quali Aziende o Enti, per finalità sociali, informative e pubblicitarie;
     
  4. Fornitore del servizio di messaggistica aziendale: soggetto giuridico autorizzato ai sensi dell’art. 25 del Codice delle Comunicazioni Elettroniche (“CCE”) che fornisce sulla base di specifici contratti con Clienti il servizio di messaggistica aziendale attraverso l’utilizzo degli Alias verso i Clienti Finali (cfr. art 4 comma 1);
     
  5. Fornitore dei servizi all’accesso: soggetto giuridico autorizzato ai sensi dell’art. 25 del CCE che fornisce i servizi mobili, tra cui il servizio di messaggistica, al Cliente Finale;
     
  6. CLI – Calling line identification: identificazione della linea chiamate mediante il numero definito dalla Raccomandazione UIT-T E.164 e nazionalmente dal Piano Nazionale di Numerazione (Del. 52/12/CIR e s.m.i.) associato alla medesima linea;
     
  7. Alias: stringa di caratteri alfanumerici trasmessa nel campo previsto per l’invio del mittente/CLI nelle comunicazioni SMS/MMS.


3. Criteri di costituzione degli Alias

  1. L’utilizzo degli Alias, è consentito ai Clienti che abbiano sottoscritto un’offerta di messaggistica aziendale con il fornitore della stessa e che hanno ottenuto in uso una o più numerazioni E.164 del Piano di Numerazione Nazionale da associare agli Alias nel rispetto dell’art.3, comma 2, della Delibera.
     
  2. Il fornitore di messaggistica aziendale adotta la massima diligenza al fine di evitare l’impiego di Alias già utilizzati per altri utenti nonché di Alias che non differiscono in maniera significativa da Alias già utilizzati.
     
  3. Ad un numero dato in uso ad un Cliente possono essere associati più Alias qualora associati ed utilizzati dal Cliente stesso.
     
  4. L’Alias è costituito in modo tale da agevolare al massimo l’individuazione, da parte del destinatario, del soggetto responsabile del contenuto della comunicazione oppure del bene o servizio offerto dallo stesso, riducendo, al contempo, le possibilità di indurre a false individuazioni; pertanto è costituito in modo da essere distintivo del Cliente, non lesivo di diritti altrui e non ingannevole per il destinatario.
     
  5. Gli Alias che richiamano Enti ed Istituzioni pubbliche sono riservati esclusivamente ai medesimi Enti o Istituzioni e non sono associabili ad altri soggetti.
     
  6. L’Alias non può essere composto esclusivamente da caratteri numerici e non può essere costituito da più di 11 caratteri.
     
  7. L’Alias è determinato nel rispetto delle norme vigenti relative ai marchi.


4. Gestione degli Alias

  1. TIS costituisce un elenco degli Alias associati a Clienti propri o che transitano su rete TIS recante per ciascun Alias almeno quanto segue:
     
    • Alias e numerazione E.164 associata;
    • Denominazione Cliente, Partita IVA e Codice Fiscale;
    • Contatti Cliente, in particolare; indirizzo, numero telefonico e, ove esistente, fax, mail, PEC, sito web;
    • data in cui l’Alias è dato in uso alla Clientela e data di cessazione quando non più in uso.
       
  2. L’elenco degli Alias viene inserito da TIS nella banca dati gestita dall’Autorità (sistema Alias) ed è aggiornato, per le nuove attivazioni, prima dell’inizio dell’impiego di un nuovo Alias ed entro le successive 24 ore lavorative nel caso di cessazione.
     
  3. TIS adotterà la propria esperienza e diligenza per assicurare il corretto utilizzo da parte dei Clienti degli Alias. L’utilizzo di un Alias da parte di un Cliente TIS è subordinato alla comunicazione a TIS da parte del Cliente delle informazioni di cui al precedente punto 1 per il caricamento nel sistema Alias. TIS si adopererà con la massima diligenza al fine di inserire nei contratti con i Clienti apposite clausole in cui questi si assumeranno la responsabilità circa l’utilizzo degli Alias e a tal fine TIS potrà far sottoscrivere al Cliente anche una apposita autodichiarazione. Ai Clienti che risulteranno aver utilizzato un Alias in modo illegittimo verrà inibito l’utilizzo del relativo Alias.
     
  4. Le specifiche informazioni da associare a ciascun Alias e le modalità di comunicazione degli aggiornamenti potranno essere aggiornate a seguito di eventuali modifiche apportate dall’Autorità.


5. Tutela del Cliente finale

  1. Il Cliente Finale che riceve un messaggio SMS/MMS avente come mittente un Alias ritenuto inatteso, ingannevole quanto alla provenienza o di spam, può contattare il Customer Care del proprio operatore di telefonia mobile segnalando il caso e comunicando all’operatore le seguenti informazioni, essenziali per effettuare i dovuti controlli:
     
    • numerazione del cliente finale;
    • Alias che appare nel campo mittente dell’SMS/MMS in questione;
    • giorno, data e ora di ricezione.
       
  2. Il Customer Care dell’operatore di telefonia mobile, attraverso l’interrogazione del database dell’Autorità riceve le informazioni relative al Cliente che ha inviato il messaggio e le comunica al Cliente finale.
     
  3. In caso di necessità, a richiesta degli uffici dell’Autorità, TIS attuerà con immediatezza tutte le misure necessarie a cessare l’impiego di Alias associati a numeri di cui è assegnataria.


6. Successive versioni del Codice
TIS si riserva il diritto di predisporre in futuro nuove e più evolute versioni del presente Codice al fine di tutelare al meglio i diritti degli Clienti finali, di pari passo con l’evoluzione dei servizi di messaggistica aziendale contenenti Alias e della relativa disciplina, attualmente ancora in fase sperimentale.
